Mark Description:

The mark consists of a three-dimensional configuration of packaging for the goods, namely a bottle. The bottle is black and the neck of the bottle is gold and black. The top of the bottle is black, yellow, gold, blue, red, white and green. On the very top of the bottle is a depiction of an ornamental coat of arms on a black circle, surrounded by a gold ring. The coat of arms comprises a shield, bifurcated in the middle into two equal sections, a left side and a right side. The left side of the shield is blue with a white bull's head. The right side of the shield is red and is separated into two sections, an upper and a lower section. In each section are situated three white clovers, two at the top of each section and one centered below. On either side of the shield are two yellow unicorns, on their hind legs whose bodies face the shield with their front legs in the air and whose heads are turned away from the shield. Another, larger bull's head, in white, is centered atop the shield. Green foliage emerges from beneath the coat of arms. Red, blue, and white foliage appears above the shield but below the larger bull's head. The rest of the top and neck of the bottle are comprised of metallic gold, some of which is beveled (depicted in hatched lines in the drawing). At the bottom of the neck, in gold, are engraved the words "THE NOLET DISTILLERY EST. 1691". Below this wording is a depiction of the coat of arms design, in black. To the left of the coat of arms design is the word "EST D", in bold black font, the "D" slightly smaller than the other letters with a black dot centered underneath, and to the right is the term "1691", in black, bold font. On the front of the bottle is a large gold rectangular label with rounded edges that covers the majority of the front of the bottle. A solid raised gold band traces the inside edge of the label. Just within the solid raised gold band sits a gold band composed of small raised dash-marks, wherein sits another thin gold band composed of several raised parallel lines. At the top of the label is a depiction of the same coat of arms described above. In this coat of arms the unicorns are depicted in gold, the bull's head is in white, the left side of the shield is blue, the clovers are white, and the right side of the shield is red. Green foliage emerges from beneath the coat of arms. Red, blue, and white foliage appears above the shield but below the larger bull's head, which is white. To the left of the coat of arms is the term "EST D", in bold, black font, the "D" slightly smaller than the other letters with a black dot centered underneath, and to the right is the term "1691" in bold, black font. Below this coat of arms is the word "NOLET'S" in large, black bold letters. The words "DRY GIN" appear centered below the word "NOLET'S" in slightly smaller, black letters. Below the words "DRY GIN" is a raised floral design, in gold, below which is a raised gold rectangle in which are situated the words "THE RESERVE" in black, bold letters, wherein the term "THE" is above the term "RESERVE". The rectangle is beveled (depicted in hatched lines in the drawing). Below this rectangle is another raised floral design in gold. Below this floral design is the word "IMPORTED" in bold, black letters, which is underlined in black. Towards the bottom of the front of the bottle is a signature, in black font and underlined in black, which reads "C.H.J. NOLET". On the side of the bottle is an indented circle in the glass in which is situated an embossed depiction of the coat of arms described above, all in gold, which is surrounded by a black circle. The broken lines depicting the edges of the bottle serve only to indicate placement of the mark and are not part of the mark. The color black appearing in hatched lines on the neck of the bottle and the rectangle on the front of the bottle, in the wording "THE NOLET DISTILLERY EST. 1691" on the neck of the bottle, in the small raised dash marks and lines around the perimeter of the large rectangular label on the front of the bottle, on the perimeter of the small rectangle within the larger label around the words "THE RESERVE", in hatched lines around the words "THE RESERVE", in the raised floral designs on the label, and on the indented circle on the side of the bottle, is used to depict depth and is not part of the mark.
