Mark Description:
The mark consists of the design elements comprising a three dimensional configuration of the portion of a single pant leg that extends from the top of the foot/instep/heel to the mid-thigh creating the illusion of a boot. The configuration can be worn, separately, in pairs and/or in combination with other accessories and articles of clothing. The upper and lower halves of the configuration are connected by a stitch that resembles a herringbone in an exaggerated dimension which begins above the inner part of the knee and extends upward in a diagonal direction to the outer-thigh. The junction of the front and back herringbone stitch lines forms a pronounced diamond figure in the inseam. The bottom of the configuration features an exaggerated rolled hem in a fluid and circular shape which gives the appearance of floating seamlessly over the top of the foot/instep/heel but which is actually secured by other means. When open, a zipper reveals a fanciful lining comprised of animal-derived fabric, in the nature of in the nature of a diamond shaped pattern, that is the same as the fanciful lining shown in the turned down cuff at the top of the configuration. The shoe, heel, zipper depicted by the dangling pull tab, and tab that secures the product under the shoe are not claimed as a feature of the mark and, with the exception of the zipper depicted by the dangling pull tab, are shown in dotted lines for purposes of demonstrating relative position. Nor does the Applicant claim any hosiery, pants, boots or similar garments which might be worn under or with the claimed configuration.
